Terms of Service

1. Introduction
Welcome to ApyGuard ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the ApyGuard platform and services, including including automated scanning, vulnerability management, reporting and penetration testing services (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree with or cannot comply with these Terms, please refrain from using the Service. You may also contact us at [email protected] with any concerns. These Terms apply to all visitors, users, and customers.
Our company, Atlada Cyber Security (owner of ApyGuard brand) is a private limited company incorporated under the laws of Turkiye, registered with the Turkiye Commercial Register, with its registered office at Bahcelievler Mah. 323/1 Cad. 2. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction. By using the Service, you confirm that you meet the minimum age requirement. We reserve the right to terminate accounts created in breach of this eligibility clause. If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.
3. Account Registration
You must provide accurate and complete information and maintain the confidentiality of your login credentials. You are responsible for all activity under your account. We reserve the right to suspend or terminate your account if the information provided is inaccurate, incomplete, or misleading.
4. Description of the Service
ApyGuard offers tiered subscription-based access to API vulnerability testing tools. Services vary by subscription level, including number of API targets, scanning depth, and report capabilities.
ApyGuard is a web-based platform accessible via standard modern browsers (e.g., Chrome, Firefox, Safari). There is no need for additional hardware. Compatibility may be limited on unsupported or outdated browsers. The Service does not require installation of local software or specialized hardware.
5. Free and Paid Subscriptions
We offer both free and paid plans. By selecting a paid plan, you authorize us to charge applicable fees. Subscription fees are billed in advance and are non-refundable unless otherwise required by law.
ApyGuard may, at its sole discretion, offer a Subscription with a free trial for a limited period of time (“Free Trial”). You may be required to enter your billing information to sign up for the Free Trial. If you do enter your billing information when signing up for the Free Trial, you will not be charged until the Free Trial has expired. On the last day of the Free Trial period, unless you cancel your Subscription, you will be automatically charged the applicable Subscription fees for the selected plan.
You will receive a reminder before your Free Trial ends and is converted into a paid Subscription. ApyGuard reserves the right to (i) modify the terms applicable to the Free Trial or (ii) cancel such Free Trial at any time without notice.
We may modify pricing or features with reasonable prior notice. Continued use after such changes constitutes acceptance.
6. Purchases and Payment Information
If you purchase any paid subscription or service made available through the Service, you may be required to provide payment details, including but not limited to your credit or debit card number, expiration date, billing address, and other relevant information.
You represent and warrant that: (i) you have the legal right to use any payment method(s) provided; and (ii) the information you submit is accurate, current, and complete. We may use third-party payment processors to facilitate transactions. By submitting payment information, you authorize us to share that information with these processors, subject to our Privacy Policy.
We reserve the right to refuse or cancel an order for reasons including but not limited to service availability, pricing or description errors, suspected fraud, or unauthorized or unlawful activity.
All prices displayed on the Service, including subscription fees, are inclusive of applicable VAT or other mandatory taxes, unless explicitly stated otherwise. If additional fees (e.g., transaction or platform charges) apply, they will be clearly disclosed before purchase.
7. Right of Withdrawal (EU Consumers)
If you are a consumer as defined under Directive 2011/83/EU, you have the right to withdraw from a subscription contract within 14 days without giving any reason. The withdrawal period will expire 14 days after the day of the conclusion of the contract.
To exercise this right, you must inform us by sending a clear written statement to [email protected]. You may use the model withdrawal form below, but it is not obligatory.
If you exercise your right of withdrawal, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed of your decision.
Important: The right of withdrawal under EU consumer law applies only if you are a natural person acting for purposes outside your trade, business, craft, or profession. If you use the Service as a business, company, or for professional purposes, this right does not apply.
8.Acceptable Use
You may only use the Service for authorized security testing. Testing third-party APIs or systems without permission is strictly prohibited. You must comply with all applicable laws and obtain necessary consents before running scans.
Prohibited activities include, but are not limited to:
- Unauthorized access or scanning.
- Malware distribution.
- Reverse engineering or tampering with the platform.
- Scanning or attacking systems without explicit permission.
- Distributing malware, spyware, or unauthorized security exploits.
- Attempting to access restricted areas of the platform.
- Engaging in any activity that violates applicable cybersecurity laws.
Any violation of these restrictions may result in account suspension, termination, or legal action. If we suspend or terminate your account, we will notify you of the reasons unless doing so would compromise our security or legal obligations.
9.Promotions and Contests
From time to time, ApyGuard may offer promotional campaigns, contests, or giveaways ("Promotions"). Such Promotions may be governed by additional terms, which will be made available alongside the offer. In case of conflict, the specific promotion terms will prevail.
Participation in any Promotion is also subject to our Privacy Policy, particularly regarding the collection and processing of personal data.
10. Analytics and Monitoring
We may use third-party analytics tools to collect information about your usage of the Service to improve functionality and user experience. These tools may collect technical data such as pages visited, features used, and system performance.
Analytics processing is carried out based on your consent or our legitimate interest in improving the Service, as further detailed in our Privacy Policy.
11. Confidentiality & Data Protection
We protect customer data in accordance with the GDPR and our Privacy Policy. This includes any data generated, processed, or stored through your use of the Service as defined in Section 1 (including API scan inputs, results, and usage-related metadata). You retain ownership of your scan data. We implement technical and organizational measures to ensure confidentiality, integrity, and availability of your data.
12. Intellectual Property
All intellectual property rights, including but not limited to software code, user interfaces, algorithms, designs, documentation, and trademarks, are and remain the exclusive property of ApyGuard.
13. Service Availability & SLA
We aim to ensure continuous access but do not guarantee uninterrupted operation. We strive for 99.9% uptime. We may update, modify, or discontinue features with notice where appropriate. Specific service levels and support commitments may be defined in a separate Service Level Agreement (SLA).
We may provide updates and modifications to ensure the conformity and security of the Service. You are responsible for implementing such updates when required.
14. End User License Agreement (EULA)
By using our software or platform, you receive a non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. You may not sublicense, reverse-engineer, or distribute the software unless explicitly authorized. Full license terms may be provided separately.
15. Data Processing Agreement (DPA)
If your use of the Service requires us to process personal data on your behalf, we will do so in accordance with a separate Data Processing Agreement (DPA) that complies with the GDPR and outlines the scope, nature, and purpose of processing. This does not replace our Privacy Policy, which explains how we process personal data as a controller. The DPA applies only where we act as a processor on your behalf.
16. Cookies and Tracking
We may use cookies and similar tracking technologies to improve your experience, analyze usage, and deliver tailored content. By using the Service, you consent to our use of cookies in accordance with our Cookie Policy. Where required by applicable law, we will request your consent before placing or accessing cookies on your device.
17. Disclaimers
The Service is provided "as is" and "as available." We do not guarantee that scans will identify all vulnerabilities. Users are solely responsible for addressing findings. We disclaim all warranties to the extent permitted by law.
18. Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. If you are dissatisfied with the Service, your sole remedy is to stop using it.
19. Governing Law and Jurisdiction
These Terms are governed by (Turkiye) law. If you are an EU consumer, you may also rely on mandatory consumer protection provisions of your country.

If you believe that a user or action on our platform violates these Terms or applicable law, you may report it by contacting us. We will investigate the issue and take appropriate action where necessary.
21. Duration and Termination
These Terms apply for as long as you access or use the Service. You may terminate your account at any time by contacting [email protected] or using the platform’s termination features. We may terminate or suspend your account for breach of these Terms, legal compliance, or at our discretion with reasonable notice.
We will notify you of the reason for termination unless doing so would compromise security, ongoing investigations, or legal obligations.
22. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify you via email or dashboard at least 30 days before the new terms take effect. If you do not agree with the updated Terms, you may terminate your account before the effective date. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
